(Pulls Out Hair). OG Theme?

I have annoyed far too many people by mercilessly asking about this on Juxt, but I will touch the sky and dig to the core and do anything it takes to get Juxt to look like the original Miiverse. I love Juxt don’t get me wrong,
it is amazing, yet the aspect of nostalgia and charm is just not there, I would love for Pretendo devs to possibly add this theme or make it an option. Pretendo Moderators, if you see this post, please help.

I do believe the Miiverse Applet should contain the theme, I have a grasp on programming, could I possibly implement the theme into the framework and allow it to appear on startup?

If anyone, absolutely anyone can help me, please do reply to this topic.

pretendo doesn’t wanna use assets that he doesn’t own, so if he does use something from nintendo then he might get sued for copyright, soo you know what the answer is gonna be.

also would it be cool when there’s at least a thousand of them needing the copyrighted og theme that not only risks of pretendo getting sued and potentially get it shut down?

I did consider that. The theme is under patent of intellectual and design property, exactly, yet it does not have to be exact,
Maybe adding some new aspects sure?

Take Rverse, they managed to get away with using the theme due to the fact that the services are discontinued, the platform as well as its corresponding themes are no longer important to Nintendo, a multi-billion dollar company.

Nintendo may be unpredictable, sure, but attacking a server for using the theme of a service that is on patent expiration would legally, be irrational.

You never know with Nintendo I guess, yet it is very, very possible, wouldn’t you think?

From what I’ve got from asking staff (since it’s been a while since we’ve had one of these inquiries), we’re not currently interested in making a classic theme for Juxtaposition.

After all, Juxtaposition is a modern reimagination of Miiverse and we intend to include features that Miiverse never had at some point.

I’m not sure whether this is legally feasible anyways, hoping I can get a more detailed response.

I Understand, Juxtaposition is literally a Juxtaposition to Miiverse, yet having a ye olde look could be quite the benefit to the platform as a whole, even just allowing people to edit a docker for Pretendo (if there is one).

I guess it would be going against what the platform is, sure but It has always been a dream of mine to get that Original feeling back for Miiverse, it just has charm. It certainly would be a bit of a challenge but I guess it is possible.

Legally, the project is possible, It would be best to not take risks, though the patent for the Miiverse UI, and UX as well as all themes have expired. Intellectual Property can not expire though. Rverse made an attempt and I guess succeeded, maybe we can just wait for Rverse3?

I dont think the OG Miiverse CSS is protected legally or anything , neither the JS or HTML

There have been hundreds of Miiverse clones using the original CSS/JS, and guess what, none of them ever got taken down because of copyright, rverse hasnt, either.

I think the reason rverse decided to stop using the Miiverse design, its because they just became unsecure/scared of being taken down when Nintendo took down a Switch emulator, which still brings Nintendo earnings every day, therefore, they did care about it.

I’m pretty sure Nintendo doesnt care about the Miiverse trademark anymore, its been abandoned since 2017.

and its not like a Game theyre still selling ,no matter how old/abandoned it is, It is just a website, in every form, Nintendo doesnt really care about that, but their important IPs and games…

Correct me if im wrong, but Nintendo would never do anything if there theorically was a Juxt theme with Miiverse design language/icons (they cant really copyright the design language, anyways, its mostly CSS gradients and icons)

THATS WHAT IM SAYING! Thank you! CSS or Design really can’t be “protected” under law it all falls under a license at the end of the day. I believe this is very possible and honestly believe it should become a feature.

Like I’ve said previously, we have no interest in implementing this at the moment.

And you would be wrong. Not only can code 100% be copyrighted, that’s literally what code licenses are designed to operate on, but the designs of websites are also considered creative works and are thus protected under copyright law. Using the original assets would achieve the same, protected, design used by Nintendo

The existence of others and the lack of action from Nintendo does not change the original protections. “Green eShop” and “the nut app” also exist and have never been taken down, that doesn’t mean what they’re doing is legally sound. It doesn’t matter if other’s have done it and not gotten in trouble. Copyright law does not function the same way some related laws like trademarks do. Under trademark law if you do not protect the trademark you are subject to losing it, but copyright ownership is effectively infinite unless it expires or is relinquished

Again, yes they can. You cannot copyright ideas/design concepts, but you can absolutely protect entire works such as the OG Miiverse design and the code that runs it. This is quite literally what copyright law and software licenses are aiming to cover, protecting creative works and providing guidelines, if any, for how you’re legally allowed to use said works

The only situation where we would consider using the OG design is if the related copyrights were either expired or relinquished. Which there is no evidence of happening any time soon. The trademarks for “Miiverse” in the United States have expired (Trademark Search) but the copyright for the application itself still remains active (WebVoyage Titles)

I’m also generally not interested in arguing about the finer details of the law outside of these surface level issues. None of us here are lawyers, so the debate ends at “there’s still copyright filings for it”
