According to one of the developers (@TraceEntertain) on Discord, there is a non-zero chance that Wii U chat will never go public.

Wii U Chat will probably never be public on Pretendo because it can’t be moderated. It was a direct video/audio call between users with no way to filter or watch what people say or do. That means people could easily use it to share inappropriate or dangerous stuff and there’s no way to stop them. Pretendo most likely wants to keep things safe and legal, so adding something like Wii U Chat would be too risky.

is there not enough moderation of the moderator or way to record the call between user (which mite be illegal idk)
Wii U Chat was live chat with no way to filter or moderate in real time. Recording calls could be illegal without user consent, depending on the country. Also Pretendo is a fan-made, volunteer-run project, so it likely doesn’t have the resources or legal infrastructure to safely handle this kind of risky feature. Even if moderation tools were possible AND they had the manpower, the liability of people misusing video chat is a big concern. And I guess nobody wants to listen in on every single call 24/7. They are not the NSA. This is just my personal opinion.
Actually now hearing that I feel like we’re better off with Wii U chat being unavailable. Even if you call with people that you “know” and “trust” it’s still extremely dangerous and without moderation, you could literally, do or say ANYTHING, AND NOT IN A GOOD WAY AT ALL. Pretendo wants to prevent cyberbullying from happening and they are extremely good at doing so, and if Wii U chat is open, this would blow open the doors to cyberbullying and people not doing very in guideline things, also, in Wii U chat YOUR FACE is open for the public to see. This would majorly contribute to cyberbullying, docxing and much more. It makes so much more sense now hearing this. If you wanna video call with your friend(s) on Wii U a great alternative is exchanging emails and voice calling on Google Meet, Zoom, Or the New "Game Chat " on Switch 2.

There is no evidence that hints to it ever being moderated. The only security layer they have is the friend-code system afaik.
