That would be legal if the games contained no Nintendo-copyrighted assets, yes. However, this isn’t currently planned because it’s just easier to get homebrew games from the Homebrew App Store, which already exists and works well.

Good point but will there ever be a patch to just use the eshop on region changed 3ds (as if you never region changed it) that would be cool
