It may have to do with varying communication manners. I read somewhere on a GBATemp forum that certain models of 3DS may have different manners of communication to servers, some running on SERV1 or an initialised signal or some running on a standard SERV0 empty signal, all signals at different addresses.
I assume that this would not apply to Pretendo servers, though it may be a cause of error.
Then again, this may be a console-based friends issue, disabling online connectivity in specific games, maybe similar to the former Wii U error.
I don’t think it’s an individual specific issue, but a server issue. There’s more people (including me) experiencing the same thing, take a look on this issue from Pretendo’s discord server:
I do believe this would be an individual issue, possibly due to a friend’s list error/instability, yet that is but an assumption, so don’t quote me on that .
Oh I see, just got the news that smash bros Wii u & 3ds were online to public it does explain on why there’s nothing happening at the moment.
Does that by any chance there are some still error that were overlooked when it came out publicly? because recently I tried to connect to any 3ds/ wii u mode but nothing is coming up.

Well, I would now figure this to be a non-server side issue, as it is related to console error. I couldn’t give you pinpoint info as I am not as interested/knowledgeable in the 3DS field, and yes, the Developers are near-certainly aware of issues, they are the creators of this after all.
